Man given 7 years in first sentencing of its kind in Quintana Roo

José María Morelos, Q.R. — A man has been handed down a seven year prison sentence for what the state has called digital violence. He is the first in Quintana Roo to be held legally liable for sharing intimate photos of another person without their consent.

On Monday, police said that Eduardo Augusto “N” was sentenced to seven years and six months in prison after being “found guilty for the crime of digital violence. The now convicted man shared a video in which he appears in an intimate moment with the victim, who at that time was his romantic partner,” they said in a statement.

“In an unprecedented event in Quintana Roo, the State Attorney General’s Office, through the Specialized Prosecutor’s Office for Trials, obtained the first conviction sentence issued by an Oral Trial Judge, for a male person, found guilty of the crime of digital violence,” they added.

Eduardo Augusto “N” was found guilty “for the events that led to his conviction which occurred between October and November 2021, when he shared with several people through social networks such as WhatsApp and Facebook, a video in which he appears in an intimate moment with the victim, who at that time was his romantic partner, without her consent,” police said.

“These events put the victim in extreme danger, as her safety was threatened, since when she went out into the street she was verbally attacked by various people in her community who denigrated and insulted her.

“Likewise, the anthropological report, in which field work was carried out, established that the victim was vulnerable not only because she was a woman, a young student, but also because she was a descendant of the Mayan indigenous community, finding herself at a disadvantage compared to her male aggressor, leaving her with serious after-effects and irreparable emotional damage,” they added.

Eduardo Augusto “N” was sentenced to seven years and six months in prison. In addition to the prison sentence, Eduardo Augusto “N” must pay a fine of 37,966 pesos, as well as the amount of 327,500 pesos for qualitative and quantitative damages.
