Cancun judge denies Playa del Carmen hotel’s request to have Profepa closure overturned

Playa del Carmen, Q.R. — The Eighth District Court of Cancun has rejected the request for suspension of a shut down hotel project. Last year, Profepa shut down the starting phase of a beach filling project being done by a hotel in central Playa del Carmen.

Earlier this week, a Cancun judge denied the hotel’s request to have that closure overturned.

In November of 2022, the Federal Attorney for Environmental Protection (Profepa) put a stop to the sand dumping project after citizen complaints of illegal structures in the public federal beach area. Upon inspection, authorities found the hotel had installed structures in the water in the Federal Maritime-Terrestrial Zone and adjacent marine area without permits.

Since the closure, the hotel filed an appeal to have the closure overturned so they could continue with the project, however, the judge denied their request. The hotel is expected to appeal.
